YES – as long as the malpractice occurred at a U.S. military hospital overseas and the person who was physically injured was a military dependent, or retired military at the time of the malpractice, you have the right to file a claim for medical malpractice.
YES – The rules are different for military medical malpractice that happens overseas. The major difference is that the only remedy is to file an administrative claim (an SF95). There is no right to file a lawsuit in federal court and have the case decided by an impartial judge. This means essentially that the Army, Air Force or Navy lawyers decide whether to settle or deny your claim. It is supposed to be an impartial, non-adversarial process where claims with merit are settled. The same lawyers whose jobs are to defend the military in stateside malpractice actions are the ones who are supposed to also be impartial and fair in overseas cases.
